Regulatory Backstory

New Hampshire authorized sports betting in 2019 and chose a competitive bid model rather than the multi-operator licensing structure most states adopted. DraftKings won the original 2019 contract by offering a 51% mobile gross gaming revenue share, far higher than competing bids. The original deal included two-year renewal options, both of which the New Hampshire Lottery Commission has now exercised. The current term runs from July 1, 2026 through June 30, 2028. The renewal kept the 51% mobile revenue share intact, conditional on DraftKings remaining the sole operator. If lawmakers were to authorize additional operators, the revenue share would automatically drop to 21% for two or three operators or 16% for four or five.

Current Market

DraftKings operates the only mobile sportsbook in New Hampshire and the only retail sportsbooks. The retail locations are at DraftKings-branded sportsbooks in Manchester, Nashua, and other partner properties. The mobile app works statewide for any verified user located inside New Hampshire. According to New Hampshire Lottery reporting, the partnership has generated more than $172 million for state education funding since launch.

The 51% revenue share is the headline. Most US states collect somewhere between 6.75% and 20% of gross gaming revenue. New Hampshire collects more than half. The tradeoff is the monopoly. With no competing operators, bettors get fewer promotional offers, fewer odds boosts, and less competitive pricing than in neighboring Massachusetts or Connecticut. The state has explicitly accepted that tradeoff in exchange for the higher revenue per dollar wagered.

The renewal through 2028 effectively locks in the monopoly structure for the next two-plus years. The promotional deduction cap for retail rose from 10% to 40% of gross revenue under the renewed contract, reflecting the higher costs of maintaining physical sportsbook locations. The mobile promotional deduction cap remains at 15%. Lawmakers have occasionally floated opening the market to additional operators, but the resulting drop in revenue share (to 21% or 16%) makes that change politically expensive for state education funding.
