When Governor Phil Murphy walked into Monmouth Park in June 2018 and placed a legal wager, he closed a six-year legal fight that ended with the Supreme Court striking down the federal ban known as PASPA. Nearly eight years later, New Jersey is still the proving ground where new operators, new products, and new tax fights play out first.
New Jersey's path started in 2011, when voters approved a constitutional amendment authorizing sports betting at racetracks and Atlantic City casinos. The leagues sued, lost at trial, won on appeal, and then lost again at the Supreme Court in Murphy v. NCAA in May 2018. Within weeks, the DGE had a temporary regulatory framework live and Monmouth Park was taking bets. The online launch followed in August 2018 with DraftKings and the FanDuel-Meadowlands partnership leading the field.
