Washington legalized sports betting in March 2020 (HB 2638) but restricted it exclusively to in-person wagering at the state's tribal casinos. There is no commercial sportsbook framework and no statewide mobile sports betting — the closest thing to mobile is on-property wagering inside tribal casino grounds via apps from Caesars, BetMGM, FanDuel, and DraftKings, each tethered to specific tribal partners. Washington also has some of the harshest online gambling penalties in the country: under RCW 9.46.240, transmitting gambling information online is technically a Class C felony, though enforcement against individual players has been essentially nonexistent.
Washington's tribal gaming footprint is enormous — 29 federally recognized tribes operate roughly 30 casinos with full slots, table games, poker rooms, and (at most) retail sportsbooks. The Washington State Lottery sells Powerball, Mega Millions, Lotto, Hit 5, Match 4, and scratchers. There are licensed card rooms (often called house-banked card rooms) that offer non-banked poker and limited table games, plus pari-mutuel horse racing at Emerald Downs and charitable gaming. Maverick Gaming's lawsuit challenging tribal exclusivity was dismissed by the Ninth Circuit in 2023, cementing the tribal-only model. There is no legal online casino, and DFS operators have largely pulled out of Washington over the felony statute.
